FEASTABLES – PRIVACY NOTICE

THIS PRIVACY NOTICE APPLIES TO THE WEBSITE WHERE IT APPEARS.

We are Feastables Inc ("Feastables", “we”, “our”, or “us”), an online retailer of snack foods, launched by the digital creator Mr Beast. 

Feastables is the controller of your personal information and is responsible for your personal information. All references to "Website", refer to the website owned by Feastables at https://uk.feastables.com/

This Privacy Notice (the "Notice") describes how we collect and use your personal information through your use of the Website, as well as your rights regarding such information.

  1. We collect and use personal information from and about you.

    Depending on the nature of your interactions with us, we may collect and process the following categories of personal information about you: 

    • Contact Information: your name, email address, phone number and mailing address.

    • Account Information: your username and password if you create an account on our Website.

    • Demographic Information: your gender, age or date of birth.

    • Communications and Feedback: reviews, comments, survey responses, messages received when you use our “chat” features, and any other information you provide when you contact us. 

    • Social Media Information: information collected via social media interactions, including any photos/videos you post on our social media pages, your social media profile information and information posted on your social media page.

    • Transaction, Payment and Preference Information: your purchase history, transaction details, payment information collected through our third-party payment processor (e.g. credit card or payment details) if you make a purchase and your preferences when using our products and services. 

    • Technical and Usage Information: your browser type, IP address, device identifiers, referring and exit URLs, page interaction information (such as what areas of the websites you visit and for how long, what search terms you enter, and what products or content you view and click on),  mouse movements, keystrokes, clicks, links you access, and screen captures. We collect this information using the tracking tools described in our Cookie Policy.

    • Promotions and Competitions Information: any content you submit as part of your entry including Contact Information, Demographic Information and Social Media Information, as well as any photos, videos or other media you submit as part of your entry, and your delivery address for prize fulfilment (if different to mailing address set out under 'Contact Information' above). 

  2. We use personal information as disclosed and described here.

    We use the categories of personal information described above for the following purposes:

    Safety, security, compliance, and due diligence purposes (e.g. protecting our company or others, including customers or business partners, detecting and investigating illegal activities or fraud in connection with a sweepstakes or other promotions or competitions,  verifying your identity if you make requests pursuant to this Notice. The verification steps and the pieces of personal information that we request may vary depending on the sensitivity and nature of your request).

    Before using your personal information for any purposes which fall outside those set out in this Section 2, we will undertake an analysis to establish if our new use of your personal information is compatible with the purposes set out in this Section 2. Please contact us using the details in Section 12 if you want further information on the analysis we will undertake.

  3. We collect information in different ways.

    We and our vendors collect personal information about you from various sources, directly and indirectly, including from the following:

    • We collect information directly from you. For example, we collect information if you contact us or sign up for our emails or if you enter into a promotional activity, competition or prize draw organised by us (including entries made via social media, through third-party promotion platforms or by submitting user-generated content such as photos or videos). We collect information if you make a purchase. We also collect information if you post a comment, enter a sweepstakes, make a request, or complete a survey.

    • We collect information from your devices. We use tracking tools like browser cookies, pixels, tags, and web beacons to collect information from and about you. We collect information when you interact with our Website, our ads, and our emails that we or our vendors send to you. We collect information about users over time and across devices when you use this Website. We may have other parties collect personal information this way. Learn more about these tools, how we use them and how you can control them below in Section 6.

    • We get information about you from vendors we hire to work on our behalf and from other sources. Other parties may give us information about you. These other parties might include business and marketing partners and social media platforms that give us information they have collected either directly or indirectly from you. Vendors that host or maintain our Website, help administer promotions or competitions, and send promotional emails for us may also give us information. Our marketing agencies, advertising technology vendors, and analytics providers may also provide us with information.

    • We combine information. For example, we may combine information that we have collected offline with information we collect online, or we may combine information we get from another party with information we already have. We may also aggregate your information with other consumers’ information to understand preferences and trends over time.

  4. Our legal basis for using your information.

    We may use your personal information on a number of legal bases as set out in this Notice and consider these to be the following:

    • Performance of a contract with you. Providing our products to you or performing a contract we have with you. In certain circumstances, we need your personal information to comply with our contractual obligation to deliver products you order from us. 

    • Legitimate interests. When processing is necessary for our legitimate interests or the legitimate interest of others. If we rely on our (or another person's) legitimate interests for using your personal information, we will undertake a balancing test to ensure that our (or the other person's) legitimate interests are not outweighed by your interests or fundamental rights and freedoms which require protection of the personal information. You can ask us for information on this balancing test by using the contact details at Section 12.

    • Consent. We may process your personal information in some cases for marketing purposes on the basis of your consent (which you may withdraw at any time after giving it, as described below). We will always obtain your consent for direct marketing communications where we are required to do so by law and if we intend to disclose your personal information to any third party for such marketing.

      If we rely on your consent for us to use your personal information in a particular way, but you later change your mind, you may withdraw your consent by contacting us at privacy@feastables.com and we will stop doing so. However, if you withdraw your consent, this may impact the ability for us to be able to provide our products and associated services to you.

    • Legal obligation. We may use your personal information where it is necessary for compliance with a legal obligation that we are subject to. We will identify the relevant legal obligations when we rely on this legal basis.

  5. We share your personal information with others. 

    We will share personal information with Mr Beast Productions and other third parties involved in administering promotions and competitions. This is for the purposes of facilitating promotions, competitions. Where we run promotions or competitions, we may share your personal information with third parties who assist us in administering and fulfilling those activities. These third parties may include promotion platform providers, prize fulfilment and delivery partners, judges or verification agencies, social media platforms through which the promotion or competition may be run, or any other third parties necessary for administering the relevant promotion or competition. 

    Our legal basis for sharing your personal information in this context is that it is in our legitimate interests to develop paid media advertising strategies and to run, grow and develop our business. Where such competitions or promotions involve direct marketing, we may also rely on your consent as a lawful basis for our processing, where we are required to obtain your consent by law.

    We will share your personal information with vendors and service providers who perform services on our behalf. Where these vendors and service providers process your personal information as our data processors, they must only process your personal information in accordance with our documented instructions.

    • Service provider(s) that host, manage, or fulfil purchases on our Website and will also share your personal information with us;

    • Service provider(s) that host and manage the chatbot services on our Website;

    • Service provider(s) who provide you with emails on our behalf and will also share your personal information with us;

    • Service provider(s) that help us investigate and prevent data incidents or audit our business and financial statements and will also share your personal information with us.

    We may share your information with our business partners, including for marketing purposes and targeted advertising. For example, we might share information with other parties who co-sponsor a promotion or our content. Some of these partners may send you information about products or services by mail or email. They may share your information with others. We also share information with third-party advertising partners through tracking tools on our Website. We may also share email addresses or other contact information with third-party partners so they can serve our advertising on their platform. These third-party partners include business and marketing partners, advertising networks, data analytics providers, social media platforms, analytics companies, data brokers, and third-party advertisers. Personal information received by these companies may also be subject to their privacy notices. These third parties may also share your information with others. These third parties may use the information for their own marketing purposes or the marketing purposes of others. This may include the delivery of targeted advertising, cross-context behavioural advertising, and interest-based advertising.     We will share your personal information if we think we have to in order to comply with the law or to protect ourselves, our customers and others. For example, we may share information to respond to a court order or witness summons. We may also share information if a government agency or investigatory body requests it. We might also share your information to enforce our agreements, and to protect the rights of others. We might also share information when we are investigating potential fraud. This might include fraud we think has happened during a competition or a promotion. If you are the winner of a sweepstakes, competition or contest, we may also share your information with anyone who requests a winner’s list.

    We may share your information with a successor to all or part of our business. For example, if part of our business is sold, we may include customer information as part of that transaction. We may share your information if there is a similar change to our corporate structure. We may also share your information with others as they conduct diligence as part of our corporate changes.

    We may share information for other reasons we may describe to you from time to time where required by law.

  6. You have certain choices about how we use your information and targeted advertising.

    You can opt out of receiving our marketing emails or texts. To stop receiving our promotional emails, you can follow the instructions in any promotional message you get from us. If you receive promotional text messages from us, you can opt out by replying “STOP”. Even if you opt out of getting marketing emails, we will still send you service-related communications that are essential for administrative or customer service purposes.

    You can control certain cookies and tracking tools. We rely on your consent to place non-essential cookies and similar tracking technologies on your device. You can withdraw your consent at any time by amending your cookie preferences via the cookie banner on our Website.   7. Your Rights.

    You have certain rights in relation to your personal information. To make a request or exercise any of your rights, please send us an email at privacy@feastables.com. You have the following rights:

    • Right of access: You have a right of access to any personal information we hold about you. You can ask us for a copy of your personal information; confirmation as to whether your personal information is being used by us; details about how and why it is being used; and details of the safeguards which are in place if we transfer your information outside of the United Kingdom or the EEA.

    • Right to rectification: You have a right to request that we correct any personal information we hold about you that is inaccurate, out of date or incomplete.

    • Right to delete your information: You have a right to ask us to delete any personal information which we are holding about you in certain specific circumstances. Note, however, that we may not always be able to comply with your request of deletion for specific legal reasons which will be notified to you, if applicable, at the time of your request. 

    • Right to restrict use of your information: You have a right to ask us to restrict the way that we process your personal information in certain specific circumstances.  

    • Right to stop marketing: You have a right to ask us to stop using your personal information for direct marketing purposes. If you exercise this right, we will stop using your personal information for this purpose.

    • Right to data portability: You have a right to ask us to provide your personal information to a third party provider of services. This right only applies where we use your personal information on the basis of your consent or performance of a contract; and where our use of your information is carried out by automated means.

    • Right to object: You have a right to ask us to consider any valid objections which you have to our use of your personal information where we process your personal information on the basis of our or another person's legitimate interest.

    • Right to withdraw consent: Where we rely on your consent as the lawful basis for processing your personal information, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of any processing carried out before you withdraw it. You can withdraw your consent by contacting us at privacy@feastables.com

    We will consider all such requests and provide our response within a reasonable period (and in any event within one month of your request). Where requests are complex or numerous, we may extend this period by up to two further months, in which case we will notify you of the extension and the reasons for it. Please note, however, that certain personal information may be exempt from such requests in certain circumstances, for example if we need to keep using the information to comply with our own legal obligations or to establish, exercise or defend legal claims.  

    If an exception applies, we will tell you this when responding to your request. We may request you provide us with information necessary to confirm your identity before responding to any request you make.  

  8. Transfers of your information outside of the UK

    In order to provide our services, we may transfer your personal information outside of the UK to the following recipients: Mr Beast Productions, based in the US, for administrative purposes; our Website hosting service provider, based in Canada; and our chatbot service provider, based in Denmark (which uses cloud services in Germany and Ireland); and third-party promotion/competition platform providers, prize fulfilment partners or other service providers involved in administering promotions or competitions, who may be based outside the UK. Where your personal information is transferred outside of the UK to any country or territory which is not subject to an adequacy decision, we will ensure that appropriate safeguards are in place to protect your personal information.

  9. Security measures and retention of personal information.

    We strive to implement appropriate technical and organisational measures to protect your personal information against accidental or unlawful destruction, accidental loss or alteration, unauthorised disclosure or access and any other unlawful forms of processing. We aim to ensure that the level of security and the measures adopted to protect your personal information are appropriate for the risks presented by the nature and use of your personal information. We follow recognised industry practices for protecting our IT environment and physical facilities. 

    We keep personal information as long as it is necessary or relevant for the practices described in this Notice. We also keep information as otherwise required by law. The criteria we use to determine our retention policies include the length of our relationship with you, your requests, your continued use of our Website, ongoing obligations such as contracts and services, and our legal obligations. 

    In relation to promotions or competitions, we will retain your personal information for as long as necessary to administer and fulfil the relevant promotion or competition, and to comply with our legal and regulatory obligations (including any tax obligations relating to prize fulfilment and the requirements of the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the "CAP Code")). Where you are a winner, this may include retaining your personal information for a reasonable period following completion of the promotion or competition to facilitate prize fulfilment and any related publicity activities. Where you are unsuccessful, we will delete any personal information collected solely for the purposes of the promotion or competition within a reasonable period following selection of the winner. This does not affect any personal information which you have separately provided to us (for example, where you have signed up to receive our marketing communications).

  10. Our Website is not intended for children. 

    Our Website where this Notice is found is meant for adults. We do not knowingly collect personally identifiable information from children or any individuals under 18. 

  11. We may link to third party sites or services we don’t control.

    If you click on a link to a third party site or app, you will be taken to a website or app we do not control. This Notice does not apply to the privacy practices of that website, app, or service, which may collect information from you. Read the privacy notices of other websites, apps, and services carefully. We are not responsible for these third parties or their policies.

  12. Feel free to contact us.

    If you have any questions or concerns about the way we have handled the personal information under this Notice, or if you would like to exercise any of your data subject rights, you have the right to contact us at any time by emailing privacy@feastables.com. You also have the right to make a complaint to us using the same contact details. We will investigate your complaint and, if you are not satisfied with the outcome of our investigation or are still concerned about our handling of your personal information, you have the right to lodge a complaint with the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues. Further information about the ICO and how to make a complaint can be found at www.ico.org.uk.

  13. We may update this Notice. 

    From time to time, we may change our privacy practices. We will notify you of any material changes to our Notice to the extent required by law. We will also post an updated copy on our Website. Please check our Website periodically for updates.
